This session will opt for an interactive, court-like presentation of the leading cases from 2026, with the audience and John Damaren (FirstService Residential) acting as the judge. The cases will be presented through arguments from both sides of the courtroom, asking the audience to opine which side had the better argument. The moderator will then provide the judge’s ruling, and the panelists will discuss what the impact is for the community as a whole. Last but not least, a Q&A will close the session, giving the audience the opportunity to ask they burning “hypothetical” questions.

Francesco Deo (Deo Condominium Lawyers), Bharat Kapoor (Horlick Condominium Lawyers), and Christopher Mendes (SV Law) have assembled the seminal court cases from 2026, and are here to present those decisions, their impacts, and what they mean for the condominium industry at large.

2026 has been an exciting and fast-paced year for the condominium industry. Legislative changes have been proclaimed, altering the way condominiums approach requisition meetings, and the CAT’s jurisdiction has been expanded to incorporate those changes. While the legislature and the CAT have been busy adopting these changes, condominium disputes continue to wind their way through the Superior Court of Justice. Decisions have been rendered which clarify existing duties, alter some long-standing precedents, and give us new ways and tools to address the issues which continue to arise for condominium communities on a day-to-day basis.

This session will provide attendees with the key Court decisions from 2026 and the legal community’s insights and takeaways. It should not be missed.
